Terms of Service

Last updated 2026-10-17

These terms are an agreement between you and Vasyl Harastei (“we”, “us”), the operator of TestWatch at testwatch.dev. By creating an account you accept them.

Please note: (1) tests and verdicts are AI-generated — review them before you rely on them; (2) above 150% of your allowance runs may be slowed (section 5); (3) you may point TestWatch only at sites you are authorised to test (Acceptable Use Policy); (4) our liability is capped (section 9).

1. The service

TestWatch writes end-to-end tests for web apps from your descriptions, runs them in our browsers, and reports and explains failures. Tests are written with the help of AI models and can be wrong. You are responsible for reviewing tests and proposed fixes before relying on them.

2. Your account and who can use TestWatch

TestWatch is a professional tool. Anyone aged 16 or over may use the Free plan. Paid plans may be bought only for a business, trade or profession (companies, sole traders and freelancers), not for personal use; when you buy one you confirm this, and that you may bind the business you name. If you use TestWatch for an organisation, you accept these Terms on its behalf.

You must give a valid email address and keep your password safe. You are responsible for activity in your workspace, including by teammates you invite. Tell us right away at hello@testwatch.dev if you think your account was misused.

3. What you may test

You may only test apps that you own or are authorised to test. Our Acceptable Use Policy is part of these terms. We may suspend a workspace that breaks it, and we act on abuse reports.

4. Your data

You keep all rights to your data: descriptions, test code, credentials and run evidence. You give us the rights we need to run the service for you. When we process personal data inside your app’s pages on your behalf, our Data Processing Agreement applies. Our Privacy Policy explains how we handle account data.

5. Plans, limits and fair use

Each plan has the limits shown on the pricing page. Runs above your monthly allowance are never billed; above 150% of it they may run at lower priority. We may limit use that threatens the service for other customers, and we tell you when we do.

6. Payments and billing

Paid plans are for business use only (section 2) and are sold by Vasyl Harastei (TestWatch). Payments are handled on our behalf by Stripe’s affiliate Sold through Link, LLC (“Link”), which acts as merchant of record for payment and indirect tax: Link charges your payment method, adds and remits any VAT or sales tax, issues receipts and invoices in its own name, and offers payment support, subscription management and refunds under its own terms (link.com/terms; support: support.link.com/topics/sold-through-link). Paying Link settles what you owe us. Your card statement shows LINK.COM* TESTWATCH. TestWatch remains your contractual partner and is responsible for the Service and product support.

Prices are set in US dollars excluding VAT; at checkout Link may show and charge the equivalent in your local currency at the rate shown there. Plans are billed in advance, monthly or yearly, and renew automatically at the then-current price until you cancel. Cancel any time from Settings → Billing → Manage billing or at link.com; your plan stays active until the end of the paid period. We announce price changes by email at least 30 days ahead; they apply from your next renewal after that notice, and you may cancel before then. There are no extra fees: runs above your allowance are never billed. Refunds follow our Refund policy, which is part of these Terms. Link’s receipt and your Billing page confirm your order; the Billing page shows the Terms version you accepted.

7. Free plan users who are consumers

If you use the Free plan as a consumer, the mandatory consumer law of your country applies to you and nothing in these Terms limits it. You can delete your account at any time. Consumers may turn to the Czech Trade Inspection Authority for out-of-court dispute resolution (see the Imprint).

8. Availability

We provide the Service with reasonable skill and care, and keep it updated and secure for the subscription period. We work to keep TestWatch available but offer no service-level agreement, except where an Enterprise contract says otherwise. We may change or discontinue features; for a material change to a paid feature we give notice under section 12.

Report problems with the Service to hello@testwatch.dev. We answer within 2 business days and fix confirmed defects within a reasonable time; where we can’t, the Refund policy applies.

9. Liability

To the extent the law allows, our total liability for all claims is limited to the greater of the fees you paid us in the 12 months before the claim and EUR 100, and we are not liable for indirect or consequential losses such as lost profits, lost revenue or lost data. This does not limit liability for intent or gross negligence, for harm to life or health, or any other liability that cannot be limited by law (§2898 Civil Code). These limits do not apply to consumers (section 7).

10. Termination

You may cancel or stop using TestWatch at any time. We may suspend or end your access if you seriously or repeatedly break these Terms or the Acceptable Use Policy. We may also end the Service for convenience with at least 30 days’ notice; we then refund the unused part of any prepaid period. After an account ends, your data stays available for export for 30 days (section 13), then we delete it as described in the Privacy Policy. If you delete a workspace yourself (Settings → Data & privacy), you can restore it, and export its data, for 7 days; after that it is deleted. Download your data before you delete if you are switching providers (section 13).

11. Law and courts

These Terms are governed by Czech law, excluding the UN Convention on Contracts for the International Sale of Goods. Between businesses, sections 1799 and 1800 of the Civil Code do not apply (§1801), and Articles 10(1)–(2) and 11(1)–(2) of Directive 2000/31/EC do not apply. The Czech courts have exclusive jurisdiction over disputes with business customers (Art 25 Brussels I bis); the locally competent court is the court for our registered seat, currently Okresní soud v Opavě (or Krajský soud v Ostravě where it is the first-instance court). Consumers keep the courts and mandatory law available to them by law.

12. Changes to the Service and these Terms

We may change the Service or these Terms for legitimate reasons: security, legal or regulatory requirements, technical evolution, changes at the AI-model or browser providers we depend on, or pricing. We email account owners at least 30 days before a material change takes effect. If you do not agree with a change, you may reject it and cancel before it takes effect; we refund the unused part of any prepaid period and charge no fee. Price changes follow section 6.

13. Data export and switching

You can export your tests at any time, and on termination, as a runnable Playwright project (Export suite in the dashboard). You can also download your apps, tests, runs, results and evidence as JSON (with screenshots and videos if you choose) from Settings → Data & privacy. On request we also export your other data — schedules, tags, notification settings and members — as JSON in a ZIP. Our prompts, heuristics and scoring are trade secrets and are not part of the export.

If you want to switch to another provider or to your own infrastructure, tell us at hello@testwatch.dev. You may give notice of up to 2 months; we then complete the switch within a transitional period of at most 30 days, and your data stays available for retrieval for at least 30 days after the contract ends. We charge no switching or data-export fees.

14. How you buy

  1. Create an account and verify your email.
  2. Choose a plan on the Billing page and confirm business use.
  3. Pay at Link’s checkout, where you can review and correct your details.
  4. The contract is concluded when you complete payment.

The contract language is English. The current Terms are always at testwatch.dev/legal/terms, and the version you accepted shows on your Billing page. You can pay with the methods Link offers at checkout (for example card, Apple Pay, Google Pay, Link or local methods). Access starts immediately after payment.

15. Sanctions and export control

TestWatch is not available in countries or to persons under EU, UN or US sanctions; Link screens payments and may cancel affected subscriptions. You may not use TestWatch in breach of export-control law.
